Website Rental Terms
read these booking conditions carefully as they, together with the specific information about your confirmed accommodation, form the basis of your contract with RENT PRIVATE VILLAS (hereafter called RPV).
Rent Private Villas is directly or through a third party rental agent and or representative dealing on behalf of owners offering their properties for holiday lettings under the following terms and conditions.
By making a reservation through RPV, you enter into a direct (legally binding) contractual relationship with the Owner of the specific property for which you make a reservation. From the point at which you make your reservation, we act solely as an agent between you and the Owner, transmitting the details of your reservation to the relevant Owner(s) and sending you a confirmation email for and on behalf of the Owner.
The information that we disclose on our site is based on the information provided to us by Owners. The Owner are given access to our website through which they are fully responsible for updating all rates, availability and other information which is displayed on RPV site. Owners reserve the right to make modifications to the property specification that are considered necessary in light of operating requirements. In the interest of continual improvement, owners reserve the right to alter furniture, amenities, facilities, or any part of any activities, either advertised or previously available, without any prior notice. Please be aware that furniture and fittings may differ from the ones shown in the advertised photos. This is usually because the originals have been replaced due to breakages or normal wear and tear. We do not accept any claims being made due to the fact that furniture and fittings may not be exactly as those shown in the advertised photos.
Distances given are approximate. Times are approximate, based on driving, not walking.
Where an inventory is provided, it is in your own interest to see that this is accurate so that any loss/damage is not wrongly attributed. Whilst we try to ensure that many of our properties are equipped with Wi-Fi internet access, we cannot be held liable for any malfunctions or technical problems with Internet Service Providers.
In properties equipped with air conditioning, this will only be effective if all doors and windows are closed whilst it is running. Neither we nor the owner can be held responsible for non effective air conditioning if this simple procedure is not followed. The owner may also levy an additional charge if electricity consumption is above the seasonal average due to non adherence to this guideline (please refer to the specific property terms and conditions).
RPV can?t we be held responsible for any errors (including manifest and typographical errors), any interruptions (whether due to any (temporary and/or partial) breakdown, repair, upgrade or maintenance of our site or otherwise), inaccurate, misleading or untrue information or non-delivery of information. Each Owner remains responsible at all times for the accuracy, completeness and correctness of the description, rates and availability displayed on RPV website.
1. PREPAYMENT, CANCELLATION, NO-SHOWS AND THE FINE PRINTS
By making a reservation through RPV site, the customer is obligate to pay the rental price , accept and agree to the relevant prepayment, cancellation and no-show policy of the specific property Owner, and to any additional (delivery) terms and conditions of the Owner that may apply during customer stay (including The Fine Print of the Owner made available on RPV site and the relevant house regulations of the Owner). The general cancellation and no-show policy of each villa owner is available on our website on the specific property page. Please check the payment terms and conditions of your villa carefully for any such conditions prior to making your reservation. Please note that a reservation which requires prepayment may be canceled (without a prior notice) if the remaining amount cannot be collected in full on the relevant payment date in accordance with the payment policy of the villa owner and you shall not be entitled to any refund of any (non-refundable) prepaid amount. Please carefully read the payment terms and conditions for additional policies as may be applied by the Owner.
Without complete payment of the amount due the customer has no right to the booked property. The owner entitled to refuse the handover of the property at the start of the rental agreement.
2. IF WE OR THE PROPERTY OWNER CANCEL OR AMEND YOUR BOOKING
The property owners reserve the right to change or cancel your booking. One of the reasons we may have to change your VILLA / BOOKING is because the owner has sold the holiday home or the holiday home is not up to standards any more. We will contact you as soon as possible as is reasonably practical and inform you of the cancellation or the change of the booking. Subject to the note below, if we make a change and you don?t want to accept it, you can take any alternative accommodation we are able to offer you (you will pay the increase in cost if the replacement is advertised at a higher price than your original booking, or receive a refund of the difference if it is less expensive) or a refund of the money you've paid to us. This does not apply where the change is not material. Examples of non-material changes include, but are not limited to, temporary withdrawal of facilities or seasonal unavailability of amenities e.g. breakdown of mechanical equipment such as pumps, boilers, swimming pool filtration systems, and the failure of public utilities such as water and electricity. In the event of discharge or our liability shall be limited to the return of the sums paid to us in respect to the unused portion of the holiday calculated on a pro rata daily basis. Subject to the note below, if we have to cancel, again we may be able to offer you an alternative. If you accept it, you would pay the difference if it was advertised at a higher price than your original accommodation, or receive a refund of the difference if it was advertised at a lower price. Or we will refund the monies you have paid us for your accommodation. We will not be responsible to pay any compensation following a change or a cancellation by us. Any amendment or cancellation fees you incur in terms of other arrangements you have made with other providers under separate contracts are not claimable from us. RPV will not be liable to refund you for any fees you any have paid to third party in connection with your holiday (including without limitation, fees for travel, entertainment, activities or insurance).
Note: If a change or cancellation occurs because of circumstances beyond our control, for example war, threat of war riot or civil strife, industrial dispute, terrorist activity (threatened or actual) and its consequences, natural or nuclear disaster, fire, adverse weather conditions, flood, epidemic or pandemic illness, action at an airport or port by any governmental or public authority, currency fluctuation, temporary, technical, mechanical or electrical breakdown with your accommodation or and all similar situations amounting to force majeure, we will have no liability to you. No compensation, costs, expenses or any other sums, including the cost of securing alternative accommodation will be paid by us.
3. THE PROPERTY
The property is rented to the customer for the booked period. The customer is obliged to solely use the property for vacation purposes and only for the maximum amount of people stated in the booking.
You can arrive at the Property at the time specified on RPV website on the arrival date on your holiday and you must leave by the time specified on RPV website on the departure dates.
If you have a late or delayed arrival on the check-in date or only arrive the next day, make sure to (timely/promptly) communicate this with the Owner so they know when to expect you to avoid cancellation of your reservation or charge of the no-show fee.
When you book accommodation through us, you accept responsibility for the proper conduct of all members of your party during your stay. Only persons stated on the booking form may use the accommodation day or night unless otherwise agreed in writing by us or the owner. RPV or the owner has the right to terminate rental without prior notice and without refund or compensation if the numbers are exceeded. We reserve the right at any time to terminate the stay of any party member(s) whose behavior is such, in the reasonable opinion of the accommodation provider, as to cause or to be likely to cause danger, upset or distress to anyone else or damage to property. Full cancellation charges will then apply and no refund will be given. Furthermore, we shall be under no obligation whatsoever to pay compensation or meet any costs or expenses (including but not limited to alternative accommodation) you may occur as a result of your stay being terminated. If you cause damage to the accommodation in which you are staying, or you leave it in an excessively unclean state, you must fully reimburse the accommodation provider concerned for the cost of the damage/cleaning before the end of your stay if the cost has been established by then or as soon as it has been established if later. You must also indemnify us for the full amount of any claim (including all legal costs) made against us by the accommodation provider or any third party as a result. If you intend to organise a function, e.g. party or wedding, at the accommodation, you must seek prior written permission from RPV and the accommodation owner. Additional charges may be sought at the owners discretion.
Every effort has been made to ensure that you have an enjoyable holiday. If however you have any cause for complaint it is important that corrective action is taken as soon as possible.
It is essential that you contact the Property Owner or his management company if any problem arises so that it can be speedily resolved.
In the event you are disappointed with the accommodation, you must contact RPV by telephone on the day of arrival, who will then attempt to resolve the problem. Note: You cannot be moved because you do not like the location. If you vacate the accommodation before the departure date, you will not be entitled to a refund. Neither we, nor the owner can be held responsible for noise or disturbance originating beyond the boundaries of the accommodation or which is beyond the owner?s control.
All properties are cared for and maintained by the owner(s) or their property manager. RPV cannot be held responsible for any breakdown of mechanical equipment such as washing machines, dryers, dishwashers, fridges, freezers, swimming pools etc, unpredictable pest issue. Rent Private Villa and the property owner(s) shall not be liable to pay any compensation.
6. CORRESPONDENCE & COMMUNICATIONS
By completing a booking, you agree to receive (i) an email which we or the property Owner may send you prior to your arrival date, giving you information on your destination and providing you with certain information relevant to your reservation and the holiday property. (ii) an email which we may send to you promptly after your stay inviting you to complete our guest review form. RPV can?t be held responsible for any direct communication between the customers and the property Owner. RPV cannot guarantee that any request or communication will be (duly and timely) received/read by, complied with, executed or accepted by the Property Owner .
In order to duly complete and secure your reservation, you need to use your correct email address. We are not responsible or liable for (and have no obligation to verify) any wrong or misspelled email address or inaccurate or wrong (mobile) phone number or credit card number.
8. INFORMATION THAT WE COLLECT FROM YOU
When you visit or register on any of our websites, you may be asked to provide certain information about yourself including your name and contact details. We may also collect information about your usage of our websites as well as information about you from messages you post to the websites and emails or letters you may send to us. To maintain customer service standards and to assist staff training, we may record and monitor incoming calls.
9. USE OF YOUR INFORMATION
Your information will enable us to provide you with access to all parts of our websites and to supply the services you have requested. It will also enable us to bill you and to contact you where necessary concerning your requests. We will also use and analyze the information we collect so that we can administer, support, improve and develop our business. In particular, we may use your information to contact you for your views on our services and to notify you occasionally about important changes or developments to the websites or our services. Further, where you have consented, we might also use your information to let you know by email, about other products and services which we offer which may be of interest to you. If you change your mind about being contacted in future, please let us know.
10. SECURITY AND DATA PROTECTION
We employ security measures to protect your information from access by unauthorized persons and against unlawful processing, accidental loss, destruction and damage. We will retain your information for a reasonable period or as long as the law requires.
11. ACCESSING AND UPDATING
You are entitled to see the information held about you and you may ask us to make any necessary changes to ensure that it is accurate and up to date. If you wish to do this, please contact us. We are entitled, by law, to charge a fee to meet our costs in providing you with details of the information we hold about you.
Neither we nor any of our officers, directors, employees, representatives, subsidiaries, affiliated companies, distributors, affiliate (distribution) partners, licensees, agents or others involved in creating, sponsoring, promoting, or otherwise making available the site and its contents shall be liable for (i) any punitive, special, indirect or consequential loss or damages, any loss of production, loss of profit, loss of revenue, loss of contract, loss of or damage to goodwill or reputation, loss of claim, (ii) any inaccuracy relating to the (descriptive) information (including rates, availability and ratings) of the Property Owner as made available on RPV website , (iii) the services rendered or the products offered by the Property Owner or other business partners, (iv) any (direct, indirect, consequential or punitive) damages, losses or costs suffered, incurred or paid by you, pursuant to, arising out of or in connection with the use, inability to use or delay of RPV website or (v) any (personal) injury, death, property damage, or other (direct, indirect, special, consequential or punitive) damages, losses or costs suffered, incurred or paid by you, whether due to (legal) acts, errors, breaches, (gross) negligence, willful misconduct, omissions, non-performance, misrepresentations, tort or strict liability by or (wholly or partly) attributable to the Supplier or any of our other business partners (including any of their employees, directors, officers, agents, representatives or affiliated companies) whose products or service are (directly or indirectly) made available, offered or promoted on or through the RPV website, including any (partial) cancellation, overbooking, strike, force majeure or any other event beyond our control.
Whether or not the Property Owner has charged you for your holiday property, product or service, or if we are facilitating the payment of the reservation price, you agree and acknowledge that the Property Owner is at all times responsible for the collection, withholding, remittance and payment of the applicable taxes due on the total amount of the holiday property price to the relevant tax authorities.
